Terms and Conditions

Last updated: May 20, 2026

These Terms and Conditions ("Terms") govern your use of the Heath Income Tax website and your engagement of our tax preparation, bookkeeping, notary, and related services. By using our website or retaining our services, you agree to be bound by these Terms.

Please read these Terms carefully. If you do not agree, do not use our website or services.

1. Professional Services

Heath Income Tax provides professional tax preparation, bookkeeping, payroll, notary, tax planning, and related financial services to individuals, families, and businesses. The specific services provided to you are governed by the engagement agreement or scope of work agreed upon at the time of your appointment.

A professional-client relationship is established only when we expressly agree in writing or verbally to provide services to you and you supply the information and documents necessary to complete those services. Use of this website alone does not establish a client relationship.

2. No Professional Advice — Website Content

The content published on this website — including blog posts, tax articles, guides, tax tips, illustrative examples, tax tables, and any other educational or informational material — is provided for general informational purposes only and does not constitute professional advice of any kind. Specifically, website content:

  • Is not tax advice rendered by an Enrolled Agent (EA) or other credentialed professional for your specific situation
  • Is not legal advice from an attorney
  • Is not accounting or CPA advice
  • Does not constitute a guarantee of any tax outcome, refund amount, savings estimate, or IRS result
  • May not reflect the most current IRS guidance, Treasury regulations, or state law changes, as tax law changes frequently

You should always consult directly with a qualified tax professional before making financial or tax decisions. Reading content on this website, submitting a contact form, or exchanging emails does not establish a client relationship or create any professional obligation on our part.

3. No Reliance — Limitation of Liability for Website Content

You expressly acknowledge and agree that Heath Income Tax is not liable for any tax penalties, interest charges, underpayments, audit assessments, IRS or state tax authority actions, or any other adverse financial or legal consequences you experience as a result of relying on any information found on this website.

This limitation applies to all website content, including but not limited to blog articles, tax guides, tax tables, illustrative examples, and general guidance, regardless of whether such content was prepared by our staff or any third party.

Our liability for errors in professional services actually rendered to you under a signed engagement is limited to the fees you paid for the specific service giving rise to the claim. We are not liable for indirect, incidental, consequential, special, or punitive damages of any kind, whether arising from use of this website or from the performance of professional services, even if advised of the possibility of such damages.

4. Client Responsibilities

To receive our services, you agree to:

  • Provide complete, accurate, and truthful information, documents, and records necessary to prepare your tax returns or perform the requested services
  • Promptly notify us of any changes that may affect your return, such as receipt of corrected tax forms, additional income, or changes in filing status
  • Review your completed return before signing and authorizing filing — you are responsible for the accuracy of the information you provide
  • Keep copies of all documents provided to us and all returns we prepare on your behalf
  • Respond in a timely manner to requests for additional information

We prepare returns based solely on the information you provide. We are not responsible for errors, omissions, penalties, or interest that result from inaccurate, incomplete, or untimely information supplied by you.

5. Fees and Payment

Our fees are based on the complexity of the work performed. Estimates are provided at the start of an engagement; final fees may vary based on actual scope. Fees are due at the time services are rendered unless otherwise agreed in writing.

We reserve the right to withhold completed returns or documents until payment has been received in full. Returned checks are subject to a returned payment fee.

6. Filing Authorization

We will not file your tax return without your explicit authorization. By signing Form 8879 (IRS e-file Signature Authorization) or an equivalent state authorization form, you confirm that you have reviewed your return, that the information is correct to the best of your knowledge, and that you authorize us to submit it electronically on your behalf.

7. IRS and State Tax Notices

If you receive a notice, inquiry, or audit from the IRS, California Franchise Tax Board (FTB), or any other tax authority related to a return we prepared, please contact us immediately. We will review the notice and advise you on the appropriate response. Responding to notices is a separate service and may involve additional fees depending on complexity.

We stand behind every return we prepare. If an error on our part results in a penalty or interest charge, we will work with you to address it at no additional charge for our time in correcting that error.

8. Confidentiality

We treat all client information as confidential in accordance with IRS Circular 230, IRC Section 7216, applicable California law, and professional standards. We will not disclose your information to third parties except as required to provide services, as authorized by you in writing, or as required by law. See our Privacy Policy for full details.

9. Intellectual Property

All content on this website — including text, graphics, logos, and design — is the property of Heath Income Tax and is protected by applicable copyright and intellectual property laws. You may not reproduce, distribute, or use website content without our prior written permission.

10. Acceptable Use and Termination of Access

By using this website, you agree not to:

  • Attempt to gain unauthorized access to any portion of this website, our servers, our hosting infrastructure, or our client systems
  • Submit false, fraudulent, abusive, or harassing information through any contact form, document portal, or communication channel on this site

  • Transmit spam, malware, viruses, or any harmful or illegal content through this website

11. Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. Any dispute, claim, or legal action arising out of or relating to these Terms, this website, or our services shall be brought exclusively in the state or federal courts located in the City of Santa Maria, Santa Barbara County, California. You consent to personal jurisdiction and venue in those courts and waive any objection to that venue.
