3. Gramm-Leach-Bliley Act (GLBA) Annual Privacy Notice
As a provider of tax preparation and financial services, Heath Income Tax is subject to the Gramm-Leach-Bliley Act Financial Privacy Rule. This section is our required annual GLBA privacy notice.
What We Share — and What We Do Not Share
We do not sell, rent, share, or transfer your nonpublic personal financial information (NPI) to nonaffiliated third parties for marketing purposes. We do not provide your information to data brokers, advertisers, or any third party for promotional use of any kind.
We share your NPI only in the following limited circumstances:
- With your authorization: We transmit your information to the IRS, California Franchise Tax Board (FTB), or other tax authorities only to prepare and file your returns or respond to notices, as authorized by your signature on Form 8879 or equivalent.
- With service providers that assist our operations: We use the following categories of third-party tools solely to deliver services to you — professional tax preparation software platforms, secure document exchange services, and appointment scheduling tools. These providers are permitted to access your information only as needed to perform those functions and are contractually required to maintain confidentiality.
- As required by law: We may disclose information when required by subpoena, court order, or government authority.
- For professional compliance: As Enrolled Agents subject to IRS Circular 230, we maintain strict confidentiality obligations regarding client information.
Your Right to Opt Out
Federal law gives you the right to limit some, but not all, sharing of your nonpublic personal information. At this time, Heath Income Tax does not share NPI with nonaffiliated third parties in any way that triggers an opt-out right under the GLBA — we share only as described above and do not share for marketing purposes. If our practices change, we will notify you and provide clear opt-out instructions before doing so. To ask questions about our current sharing practices or to exercise any opt-out right, contact us at heathincometax@gmail.com or (805) 937-4646.
4. IRC Section 7216 Compliance
Under Internal Revenue Code Section 7216 and its implementing regulations (26 C.F.R. §301.7216-1 through 3), we are prohibited from disclosing or using your tax return information for any purpose other than the preparation and filing of your tax return without your express written consent.
We do not use your tax return information for marketing, client profiling, or any secondary purpose. We do not sell, license, or share your tax return information with any third party for commercial gain.
If you ask us to share your tax return information with a third party — for example, to provide copies to a lender or mortgage company — we will obtain your written consent through a separate IRS-compliant consent form before releasing any information.
We do not place advertising tracking pixels, marketing analytics tools, or behavioral data collectors on any page where tax return information is submitted or displayed.
5. How We Protect Your Information
We maintain physical, electronic, and procedural safeguards appropriate for a tax preparation practice, including:
- Secure, encrypted file transfer for electronic document exchange
- Password-protected systems with limited staff access to client records
- Physical security measures for paper documents stored in our office
- Secure destruction of documents when no longer needed
No method of internet transmission or electronic storage is 100% secure. If you have concerns about transmitting sensitive documents electronically, please contact us to discuss alternatives.
6. Data Retention
We retain client tax records and supporting documents in accordance with IRS guidelines and California law, generally for a minimum of seven years. Records may be retained longer if required by applicable law or professional standards.
IRS record-keeping requirements under 26 U.S.C. §6001 and related regulations may supersede standard deletion requests for tax-related records. If you request deletion of records we are legally required to retain, we will identify the specific retention obligation, inform you of it, and delete all records not subject to that requirement.
7. Cookies and Website Tracking
Our website may use cookies and similar technologies to improve your browsing experience and analyze traffic. You can disable cookies in your browser settings, though some website features may not work correctly if you do.
We do not use advertising networks, behavioral tracking cookies, or third-party marketing pixels on any page of this website, including document submission or confirmation pages.
8. Children's Privacy
Our website is not directed to children under 13. We do not knowingly collect personal information from children. If you believe a child has submitted information to us, please contact us and we will delete it promptly.
9. Your Privacy Rights — Right to Know, Access, Correct, and Delete
Depending on your state of residence, you may have the following rights regarding your personal information:
- Right to Know: You may request a summary of the categories and specific pieces of personal information we hold about you, and how we use and share it.
- Right to Access: You may request a copy of your personal information in a portable format.
- Right to Correct: You may request correction of inaccurate information we hold about you.
- Right to Delete: You may request deletion of personal information we hold. Note that IRS and California record-retention requirements (generally seven years for tax records) require us to retain certain records regardless of your request. We will delete everything not subject to a legal retention obligation and explain in writing what we must keep and why.
- Right to Non-Discrimination: We will not deny services, charge different prices, or otherwise discriminate against you for exercising any of these rights.
California residents have additional rights under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA), including the right to know whether we sell or share personal information (we do not) and the right to limit the use of sensitive personal information.
To submit a privacy rights request: Contact us in writing at heathincometax@gmail.com or by mail at the address below. We will acknowledge receipt within 10 business days and respond within 30 calendar days. We may need to verify your identity before processing your request.
10. Changes to This Policy
We may update this Privacy Policy from time to time. When we do, we will revise the "last updated" date at the top of this page. Continued use of our services after any changes constitutes acceptance of the updated policy.
